It is illegal to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. If you purchase products from us, you warrant to us that you are over the age of 18 years and any person that you are obtaining the products for, or supply the products to, is over the age of 18 years.

By visiting and using this website you accept and agree to be bound by the following terms and conditions. We may change these terms and conditions at any time without notice. Please review these terms and conditions regularly to ensure you are aware of any changes made.

Quotations

All quotations are subject to withdrawal or variation at any time prior to acceptance of order.

Product Availability

Demilt Wines products are offered for sale on the basis of while stocks last. If a product is out of stock, Demilt Wines will notify you within two days and will assist you in substituting wines of at least equal quality and value or a full refund.

Acceptance of Order

Acceptance of the quotation constitutes an acceptance of all these terms and conditions. A confirmation email will be sent to you listing the product ordered and cost, the total delivery fee and the address for delivery.

Cancellation of Order

Where the customer cancels an order (unless by mutual agreement as to terms of compensation) a breach of contract occurs entitling Demilt Wines to recover its loss of the bargain made including loss of profit. The customer agrees to pay forthwith the loss notified upon wrongful cancellation.

Matters Beyond the Control of Demilt Wines
The customer agrees that Demilt Wines cannot be required to fulfil its obligations in meeting orders placed where circumstances reasonably beyond its control including but not limited to war, accident, acts of God, industrial action, embargo, delay or failure or default by suppliers or the like, preclude such performance by Demilt Wines.

Inspection

The customer agrees to inspect the goods immediately on their arrival and must within seven (7) days from arrival give notice to Demilt Wines of any defect or other matter not in accord with the contract. For any defect regarding wines, the customer will keep the cork and the wine in its bottles. These requirements must be fulfilled before a refund can be considered. Wines with a vintage older than five years are excluded.

Prices

All prices are subject to change without notice. All transactions are carried out in Australian dollars and are subject to GST and Wine Equalisation Tax (WET).

Payment

All goods must be paid for prior to or no later than at delivery unless credit terms have previously been made with Demilt Wines. If the customer receives goods on credit, no subsequent order will be accepted until such time as the customer has no outstanding payments due and owing. The customer may be charged reasonable expenses for a delivery attempted for which payment is not made.

Security for Payment

All goods supplied by Demilt Wines on terms of credit are subject to a security interest which will be registered by Demilt Wines on the Personal Property Securities Register.

Interest

The customer agrees to pay interest calculated on a daily basis on any order not paid at delivery excepting where credit terms are agreed, at the rate which is two (2) percent above the rate charged on overdraft loans by the Commonwealth Bank for loans exceeding $100 000.00 until full payment is made.

Australian Consumer Law (ACL)

Consumer rights under the ACL are not intended to be abridged by the above terms and conditions but operate to amplify and clarify such rights within the context of the ACL.
